These terms apply to anyone selling, donating or buying items through Bàmíwàlé Marketplace, a service of Bàmíwàlé Real Estate Enterprise, Maryland, Lagos ("Bàmíwàlé", "we"). By replying "I agree" on WhatsApp, submitting our declutter form or paying for an item, you confirm you've read and accept these terms.
1.1 We list pre-loved household items for sellers, find buyers, take payment from buyers, and pay sellers once the sale is complete.
1.2 We don't own, store, collect, deliver or transport items, and we don't inspect them in person. The sale is between the seller and the buyer. Bàmíwàlé acts as the seller's agent for listing and payment only.
1.3 We hold buyers' payments in a Bàmíwàlé business account kept for customer money, separate from our own spending, until the sale is complete or the buyer is refunded.
2.1 Price. We set the listing price with you, using the pricing guide below and what similar items are selling for in Lagos right now. You can accept our price or send one counter. If we can't agree in that one round, we won't list the item. The agreed price is what buyers pay. We don't add anything on top.
2.1A Pricing guide. Listing prices are based on what the same item costs new today:
| Condition | Listing price |
|---|---|
| Like new: under 1 year, no marks | Up to 60% of today's new price |
| Good: 1 to 3 years, light wear | Up to 45% |
| Fair: over 3 years, or visible wear | Up to 30% |
Electronics and appliances usually sit at the lower end. What you originally paid, sentimental value and "it's still strong" don't change what buyers will pay, so they don't change the price.
2.2 Commission. When your item sells, we keep a commission from the selling price. Listing is free, there's no charge if the item doesn't sell, and Bàmíwàlé pays the payment processing fee.
| Agreed selling price | Our commission | You receive |
|---|---|---|
| Up to ₦50,000 | 20% (minimum ₦3,000) | 80% |
| ₦50,001 to ₦300,000 | 15% | 85% |
| Above ₦300,000 | 10% | 90% |
| Donations | Free | – |
2.3 VAT. Our commission doesn't include VAT. Bàmíwàlé is currently below the VAT threshold, so no VAT is charged. If that changes, we'll add VAT at the legal rate (currently 7.5%) to our commission only, never to the item price, and tell you before you list.
2.4 Payout. We pay you the selling price minus commission on the 4th day after the buyer collects, once the 3-day check period in 3.5 has passed with no complaint. If a complaint is open, we pay once it's resolved. We pay only into a Nigerian bank account in your own name.
2.5 Your promises. You confirm that you own the item or have the right to sell it; that it isn't stolen or counterfeit; that your photos and description are accurate and include every fault you know of; and that the item is safe and works as described. We may ask for proof of ownership, such as a receipt or photos of the item in your home, and decline to list it if you can't provide it.
2.6 Keeping the item available. Keep the item in the condition shown while it's listed. If it sells elsewhere, is damaged, or you change your mind, tell us at once. If a buyer has already paid, we'll refund them in full, and we may decline future listings from you.
2.7 Handing over. Only release the item to the buyer we name to you on WhatsApp, after we confirm they've paid. Let them inspect it before loading. Never accept payment from the buyer directly.
2.8 Listing period. Listings run for 14 days. When we agree the price, we also agree a day-7 price, the lowest you'll accept. If the item hasn't sold by day 7, we drop it to that price without asking again. At day 14, you can donate the item through us, remove the listing, or relist once for 7 more days at a lower price.
2.9 Items we don't accept. Broken or unsafe electrical items, counterfeit or stolen goods, items you can't show you own, used mattresses and pillows, weapons, medicines, food, and anything illegal under Nigerian law. We may decline or remove any listing at our discretion.
3.1 Paying. Pay only through the Paystack link we send you, or into a Bàmíwàlé business account we name in writing. We will never ask you to pay into a personal account. The item is reserved once your payment is confirmed. Unpaid links expire after 24 hours.
3.2 Collection. Collect the item from the seller's location within 3 days of payment, at a time you agree with the seller. You arrange and pay for your own transport and loading help.
3.3 Inspect before you load. Check the item at collection, and switch on electrical items where you can. If it isn't as described, don't take it: message us before you leave, and we'll refund you in full within 48 hours.
3.4 Confirming. When you're happy, reply "Collected and confirmed" on WhatsApp. If we don't hear from you within 24 hours of collection, we treat it as confirmed.
3.5 Hidden faults: 3-day check period. If, within 3 days of collection, you find a fault that the seller didn't disclose and you couldn't have spotted at inspection, send us photos or a video within those 3 days. We pause the seller's payout and follow the dispute process in section 6.
3.6 No other returns. Pre-loved items are sold as seen. Apart from 3.3 and 3.5, there are no returns or refunds, including for a change of mind or damage after the item leaves the seller.
3.7 Not collected. If you don't collect within 7 days of payment, we'll refund you minus the payment processing fee, and the item may be sold to someone else.
3.8 Keep it on Bàmíwàlé. Once we've introduced you, complete that sale through Bàmíwàlé. If a seller and buyer complete a listed sale outside Bàmíwàlé, the seller still owes our commission, and we may decline future listings from both.
4.1 Donating through us is free. We connect your item with a person or group who needs it, and they collect it from you. Clauses 2.5, 2.7 and section 5 apply.
5.1 Seller and buyer are each responsible for their own safety during collection. Meet in daylight where possible, and bring someone with you for large items.
5.2 Bàmíwàlé isn't responsible for injury, loss or damage during collection, loading or transport, or for faults a buyer didn't raise under 3.3 or 3.5.
5.3 As far as the law allows, Bàmíwàlé's total responsibility for any sale is limited to the amount the buyer paid for that item. Nothing in these terms limits rights you have under Nigerian law, including the Federal Competition and Consumer Protection Act 2018.
6.1 Message us on WhatsApp at 0902 234 6117 or email bamiwalelagos@gmail.com. We'll reply within 1 working day.
6.2 A dispute between a buyer and a seller goes through our dispute process, which lasts up to 7 days. We share each side's evidence and help you agree an outcome in good faith.
6.3 If you agree, we act on it: we pay the seller, or refund the buyer in full or in part. If a fault is confirmed and the item goes back, the buyer returns it to the seller and is refunded in full, and no commission is charged.
6.4 If there's no agreement within 7 days, Bàmíwàlé makes a final decision based on the evidence, and pays or refunds accordingly.
6.5 False claims. Claiming a fault that isn't real, sending altered or misleading photos, or otherwise abusing this process is fraud. We may refuse a refund, ban you from Bàmíwàlé and take legal action.
7.1 We share a seller's first name, phone number and pickup area with a buyer only after the buyer has paid, and the buyer's name and number with the seller at the same time. We use your details only to run your sale, in line with the Nigeria Data Protection Act 2023. See our privacy page.
8.1 These terms are governed by the laws of Lagos State and the Federal Republic of Nigeria.
8.2 We may update these terms. The version on our website when you list or pay applies to that sale.
